TERMS AND CONDITIONS

1. These terms and conditions of entry, which include information on how to participate and the prize details, apply to the “Holden Scramble Delta Airlines” promotion. Entry into the promotion is deemed acceptance of these terms.

PROMOTER

2. The Promoter is Professional Golfers Association of Australia Limited, 600 Thompsons Rd, SANDHURST VIC 3977, (03) 8320 1911, ABN 46127641829

PROMOTION PERIOD

3. “Holden Scramble Delta Airlines” promotion will be open from 10.00am AEST on Tuesday 1st March 2016 and run until 5:00pm AEST on Sunday 2nd October 2016.

ELIGIBLE ENTRANTS

4. Entry into the promotion is only open to Australian residents who:
a. Are a PGA Member (Professional Golfers Association Member) or nominated Host Golf Club Holden Scramble Coordinator;
b. Ran either a Mixed and Women’s Holden Scramble Local event between March 1 and October 2, 2016 in Australia;
*Note – Each Holden Scramble Mixed and Women’s event run by a PGA Member or a nominated Host Golf Club Holden Scramble Coordinator will receive one entry in to the draw.

Entry excludes:
a. Management, employees, directors and contractors of the Promoter, its related bodies corporate, and other agencies, firms or companies associated with the Promotion (including suppliers of prizes);
b. Persons who have used or attempted to use more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal name change) and
c. Persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter

HOW TO ENTER:

5. Eligible Entrants can complete their entry during the Promotion Period by:
a. Submitting confirmation of Holden Scramble Local event to the PGA of Australia Events Division by completing the Local Event Confirmation Form:
i. Indicating their acceptance of these terms and conditions.

6. The Promoter reserves the right at any time to verify the validity of any entrant and to disqualify any entrant who submits an entry not in accordance with these terms and conditions.

PRIZE DRAW

7. The random electronic prize draws will be conducted at Professional Golfers Association of Australia Limited, 600 Thompsons Road, SANDHURST VIC 3977 on Friday 7th October at 10:00am AEST

PRIZE INFORMATION

8. Prize draws are to be awarded to the lucky winner are as follows;

Prize Draw includes:
i. Two Return Economy airfares from the winner’s nearest capital city to Sydney valued at up to $1000 RRP (including GST) (depending on point of departure)
ii. Two return economy class airfares flying Delta Airlines to a USA destination of their choice which may include one of the following: Los Angeles, San Francisco, Las Vegas, New York, Orlando, Louisville, Chicago, Atlanta;
iii. The prize includes airfares only, no accommodation, meals, transfers, Visa’s or other incidental expenses.
iv. The prize must be redeemed prior to 31st December 2017 and all bookings are subject to availability on the chosen date and time.
v. Total Value: $4,800 RRP

9. The Trips for Prize Draw Two must be redeemed and completed between 08/10/2016 and 31/12/2017.

10. Prize Draw Two is for Economy Airfares only; tickets are non transferrable and cannot be upgraded due to internal Delta Air Line Policies. No change in the air line tickets will be accepted.

The Trips do not (except as expressly stated) include:

i. any overnight accommodation while travelling to the departure airport ;
ii. any other travel or accommodation, other than stated for prize draw one;
iii. any food and beverages;
iv. any incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages);
v. any insurance (such as travel or health cover). The Promoter requires the winner and their travelling companion cover themselves with full travel insurance valid for travel to the United States of America (USA). Receipt of insurance for each person travelling must be supplied to the promoter prior to travel. Should the winner and their travelling companion fail to take out travel insurance, the Promoter will require them to sign a waiver prior to travel;
vi. any vaccinations or other medical or health related services;
vii. any other ancillary costs which may be incurred by those travelling.

The Trip winners and nominated companions must hold valid passports and visas (if required) for travel.

The Trip winners and nominated travelling companions are responsible for compliance with any health, passport (including validity of passport), visa and other requirements for entry into the USA (Entry Requirements).

The Trip winner and their travelling companion are responsible for making themselves familiar and following the Australian travel advisory and consular assistance advice available at www.smartraveller.gov.au

All aspects of the Trips (including travel and accommodation) are for the two (2) people travelling together at all times.

Once booked, changes to the traveller details, travel or flight arrangements cannot be made.

The Trips cannot be exchanged for other travel or flights at other destinations.

Any part of the Trip that is not taken for any reason is forfeited.

Participation in the Trip is subject to such other terms and conditions as may be imposed by those involved in providing other goods or services included in the Trip (Third Party Terms).

The Trip winners and nominated travelling companions participating in the Trip are responsible for compliance with all applicable Entry Requirements and Third Party Terms and bear all risks associated with failure to comply with any of them. They will be required to maintain an acceptable standard of behaviour while a participant in the Trip. The Promoter assumes no liability (and will provide no compensation) to the Trip winners and/or nominated travelling companions who, as a result of any failure to comply with any Entry Requirements or Third Party Terms:

i. is unable to participate in the Trip (or any part of it); or

ii. is refused entry into any country; or

iii. suffers any other loss or damage.

TOTAL VALUE OF PRIZES

11. The total value of prizes available for distribution in the Promotion is up to $4,800.00

NOTIFICATION OF WINNERS

12. Winners will be notified by phone call and email and within 10 days of the draw. The winners of prizes valued over $250 will also be published on the Holden Scramble Website (thescramble.wpengine.com) on Monday the 10th October 2016.

REDRAWS

13. If any Prize Draw remains unclaimed a redraw will be conducted at the Professional Golfers Association of Australia Limited, 600 Thompsons Road, SANDHURST VIC 3977 on Tuesday 31st January, 2017 at 10:00am AEST

14. The redrawn winner(s) will be notified directly in writing within 2 days of each scheduled draw.

15. The redrawn winner(s) will be posted on the Holden Scramble website (thescramble.wpengine.com) by Friday 3rd February 2017.

ADDITIONAL GENERAL CLAUSES

16. An entrant or Prize Winner must, if requested by the Promoter, agree to and sign:

I. an eligibility form confirming their compliance with the Conditions of Entry and eligibility to accept the prize; and/or

II. a liability release in a form to be determined by the Promoter at their discretion.

In the case of an Entrants’ and or the Prize Winner’s failure to return the signed eligibility form, releases and indemnities will result in the disqualification of that entrant from the Promotion.

A reply paid address will be provided.

17. Prizes must be taken as stated. All prizes are non-transferable or redeemable for cash.

18. A prize cannot be sold, scalped, auctioned, raffled, pledged, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. If a prize is obtained through any of these methods, it will not be honoured.

19. Unless expressly stated within these Conditions of Entry regarding a prize, all other expenses become the responsibility of the winner.

20. In the event that for any reason the prize winner does not take the whole or part of a prize at the time stipulated by the Promoter then that whole or part of a prize will be forfeited by the prize winner. Neither cash nor other form of compensation will be supplied in lieu of the forfeited whole or part of a prize.

21. The Promoter shall not be liable for prizes being lost, stolen, damage or tampered with in any way before it reaches the winners.

22. The Promoter accepts no responsibility for any variation in the value of Prizes.

23. If the Promoter is unable to provide a winner with a nominated prize the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated prize, subject to any direction given by State and /or Territory Gaming departments.

24. If for any reason the Promotion is not capable of being run as planned, including due to war, terrorism, state of emergency, the infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to State and Territory regulation, including cancelling, terminating, modifying or suspending the Promotion.

25. Any entrant who in the opinion of the Promoter, tampers or interferes with the entry mechanism or draw in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.

26. The Promoter reserves the right to disqualify entries in the event of non compliance with these Terms. The Promoter’s decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.

27. Entrants consent to the Promoter using the entrants name, likeness, image and/or voice in the event they are a prize winner (including photograph, film and/or recording of the same in any media for an unlimited period without remuneration for the purpose of promoting this competition and the Holden Scramble.

28. In the event that there is a dispute concerning the conduct of the Promotion or awarding of a prize the decision of the Promoter will be final and no correspondence will be entered in to.

29. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

30. Personal information contained on the web entry will be used for the purpose of determining and/or contacting the prize winner and disclosed to third parties, including but not limited to contractors and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period (unless the entrant requests otherwise in writing) use the information for promotional, marketing, publicity, research and profiting purposes. All entries become the property of the Promoter. The Promoter complies with the National Privacy Principles. Entrants can gain access to the personal information held by the Promoter by phoning or writing to the Promoter at the address outlined in Clause 2.
