TERMS AND CONDITIONS FOR VOLKSWAGEN SCRAMBLE “Scramble Ambassador” PROMOTION (Promotion)

The Promoter is the PGA of Australia, Sandhurst Club, 600 Thompson Rd, SANDHURST VIC 3977, ACN 127 641 829.

OFFICIAL RULES

To Enter, the entrant must, compete in a Volkswagen Scramble Local Event, for further details:

  1. The following document (“Official Rules”) contains information and constitutes the official rules on how to enter the Volkswagen Scramble “Scramble Ambassador” Giveaway (“Promotion”) and describes the prizes to be awarded as part of the Promotion. Entry into this Promotion is deemed acceptance of these Official Rules.
  2. The Promotion is open to residents of Australia in all eligible states/territories, except employees, officers, directors or representatives of PGA of Australia, Sandhurst Club, 600 Thompson Rd, SANDHURST VIC 3977 or any company or agency associated with this Promotion and their employees, officers, directors or representatives (collectively “Promotion Parties”) or any immediate family members of the Promotion Parties. A valid entrant (“Entrant”) must be a permanent resident of Australia currently residing in Australia, and 18 years and older.
  3. The Promotion commences 00.01 am AEST 00.01 am AEST Saturday 1 August 2020 and closes at 11.59 pm AEST on Wednesday 31 March 2021*. (*the “Promotion Period”). Events played outside of promotion period will be accepted as part of the promotion.
  4. Promotion must be entered via competing in a Volkswagen Scramble Local Event during the Promotion Period, as follows:
    1. Entrants must compete in a Volkswagen Scramble Local Event during the Promotion Period, to receive an entry (“Entry”).
    2. An entry will be given per Volkswagen Scramble Local Event competed in.
    3. Any entry deemed unlawful under the Volkswagen Scramble Official Rules will be prohibited, see the “Volkswagen Scramble website” https://thescramble.com.au/wp-content/uploads/2019/08/Volkswagen-Scramble-Condition-of-Competition-2019.pdf
  5. The Promoter reserves the right to verify the validity of Entries, and Entrants, at any time during or after the Promotion Period, and reserves the right to disqualify any Entrant who tampers with the Entry process or who submits an Entry that is not in accordance with these Official Rules. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  6. The Promoter’s decisions in relation to all aspects of this Promotion and the random draw are final and binding on all Entrants and no correspondence will be entered into.
  7. Entrant acknowledges that the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering the Promotion, Entrant hereby releases Facebook of any and all liability, whether direct, indirect, special or consequential, arising in any way out of the Promotion.

THE PRIZE

  1. The single winner, as drawn by The Promoter, will receive the following prize (the “Prize”):
    1. Merchandise from Callaway Golf South Pacific
    2. Apparel from Adidas Golf Australia
    TOTAL PRIZE POOL (including GST): $7,000.00
  2. Conditions for redemption of the above Prize are as follows:
    1. The Prize does not include any ancillary costs associated with redeeming the Prize; these are the responsibility of the winner;
    2. The Prize or any portion of it is not transferable or exchangeable. The Prize is not redeemable for cash.

DETERMINATION OF WINNER

  1. A random prize draw will occur at 12.00 pm AEDT on Wednesday 8th April, 2021. The location of the draw: the PGA of Australia, Sandhurst Club, 600 Thompson Rd, SANDHURST VIC 3977, Australia. All times are in AEST and AEDST, as applicable. The winner will be notified via email and phone using the contact details given in his/her Entry no later than 48 hours after all entries have been drawn.
  2. The winner will be notified and published here: https://www.facebook.com/VolkswagenScramble by 5:00pm AEDT on April 22nd, 2021.
  3. All Entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the Entrant.
  4. If the prize has not been claimed, a random unclaimed prize draw will occur at 12.00pm AEDT on June 16, 2021 by the Promoter. Location of draw: the PGA of Australia, Sandhurst Club, 600 Thompson Rd, SANDHURST VIC 3977, Australia. The winner of the unclaimed prize will be notified and published here: https://www.facebook.com/VolkswagenScramble on June 16, 2021.

USE OF ENTRIES

  1. By entering this competition, The Promoter is entitled to use any of the Entries submitted in any manner and for any purpose in its absolute discretion, including using the Entries for future promotional, marketing and publicity purposes and use within the public viewing gallery on the Facebook Page and in any other form of media now known or hereafter invented, without any further reference, payment or other compensation to the Entrant.
  2. The Entrant acknowledges that his/her entry may be published on both the Internet and within various titles from the Promoter, together with his/her name.
  3. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the Entrant cannot be contacted during business hours on the relevant dates.
  4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s mobile number) and to disqualify any ‘entrant’ who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  5. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

Without limiting any other terms herein, the Entrant agrees to indemnify the Promoter for any breach of the above terms.

GENERAL

  1. Neither the Promoter or any company associated with this Promotion accepts responsibility for any tax implications from acceptance of any prize. Independent financial advice should be sought by entrants regarding the tax implications for the winner of accepting a prize.
  2. If for any reason the Promotion is not capable of being run as planned, for any reason, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to State and territory regulation, including cancelling, terminating, modifying or suspending the Promotion.
  3. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the consumer guarantee provisions of the Australian Consumer Law.
  4. Subject to paragraph 3 and to the extent permitted by law, the Promoter excludes all liability to the winner for any costs, expenses, losses and damages suffered or incurred by the winner, including any liability for personal injury or death, liability due to negligence of the Promoter or its personnel, whether direct, indirect, special or consequential, arising in connection with the Competition, the prizes or any component of the prizes.
  5. To the extent permitted by law, the Promoter also excludes all liability for any costs, expenses, losses and damages suffered or incurred by any winner or any entrant, including any liability for personal injury or death, liability due to negligence of the Promoter or its personnel, loss of business opportunity whether direct, indirect, special or consequential, arising in connection with:
    1. the participation in the Competition by any entrant or the winner;
    2. the use of the prize by any winner;
    3. any tax liability incurred by a winner or entrant; or
    4. any variation in the prize value stated in these terms.
  6. If, for any reason, there is any interference or disruption in the conduct or operation of the Competition (including due to power or technical failure, natural disasters, acts of God, computer viruses), the Promoter reserves the right to suspend, cancel, terminate, modify or recommence the Competition subject to the approval of any applicable government authorities.
  7. Each entrant consents to the Promoter using, without any fee or other remuneration, the name, likeness and image of the entrant and the Promoter taking, recording and using images, audio or audio visual content (including video) of the entrant for the purpose of promoting the Competition, the Promoter, the commercial partners of the Promoter or the products and services of the Promoter or its commercial partners in any way the Promoter considers appropriate. Each entrant agrees to sign any image release or other document required by the Promoter to give effect to this clause 7.
  8. Valid and properly completed entries will only be accepted by the Promoter once received by the Promoter. The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information.
  9. The information an entrant provides the Promoter will only be used by the Promoter for the purposes outlined in these Terms and Conditions.
  10. The Promoter will publish the details of the prize winner on the Volkswagen Scramble social media pages.
